Terms of Service

Thank you for choosing to use the forghetti platform!

Please read these terms of service (“Terms”) carefully because it sets forth legal rights and obligations and cover your use and access to our services, client software and websites ("Services").

1. Application of this agreement

If you subscribe to the service for a defined period of time (the “Initial Term”), then, unless you decline to renew your subscription in accordance with the below, this Terms of Use Agreement will be automatically renewed for additional periods of the same duration as the Initial Term at Forghetti’s then-current rates for such Service.

2. Definitions

“Agreement” refers to these Terms of Service;

“App(s)” refers to our mobile, desktop and browser applications made available to you through Apple AppStore, Google Play, Android Marketplace or other app stores or indeed the Forghetti website;

“Forghetti” refers to one of the following: our company (the official name of which is “Forghetti Ltd.”); our Website; our Service (currently offered under the brand “forghetti”); or a combination of all or some of the foregoing, depending on the context in which the word “Forghetti” is used;

“Registered User” refers to a User who has registered for an account via a Service (“Account”).

“Service” or “Services” refers to the services that we provide, including our Apps and our Website;

“Website” refers to any website controlled by us where this Agreement appears, including www.forghetti.com;

“User” refers to users of our Services;

“You” (whether or not capitalised, and including variations such as “your,” etc.) refers to you, the person who is entering into this Agreement with Forghetti.

3. What is forghetti?

Forghetti is a digital platform (mobile, desktop, web and future formats), that persistently generates passwords, pin numbers, words and a combination thereof on demand when that demand is triggered by the inputting of a unique personal identifier “UPI”.  This UPI is in the form of a multi-layered pattern or “doodle” but could be any format in the future including but not limited to facial recognition, finger print ID, master password or numerical code.

4. Our service

Your agreement is with Forghetti Ltd. Our Privacy Policy explains how we collect and use your information while our Acceptable Use Policy outlines your responsibilities when using our Services. By subscribing to the service, you’re agreeing to be bound by these Terms, our Privacy Policy, and Acceptable Use Policy. If you’re using our Services for an organisation, you’re agreeing to these Terms on behalf of that organisation.

Privacy And Security Principles. Since we started Forghetti, we’ve built our Services with strong privacy and security principles in mind.

Sharing With Other Users.  Forghetti works with other service providers to help us provide ways for you to connect with their services. We do not receive any information from them to help operate or provide our Services.

International Services. To operate our Service internationally, we need to store and distribute content and information in data centers and systems around the world, including outside your country of residence. This infrastructure is owned or operated by our service providers or their affiliated companies.  All of the Forghetti platform is hosted on the infrastructure provided by the Google Cloud Platform.

Registration. You must register for our Services using accurate information, provide your current mobile phone number, and, if you change it, update your mobile phone number using our in-app change number feature. You agree to receive text messages (from us or our third-party providers) with codes to register for our Services.

Age. You must be at least 13 years old to use our Services or such greater age required in your country to register for or use our Services. In addition to being of the minimum required age to use our Services under applicable law, if you are not old enough to have authority to agree to our Terms in your country, your parent or guardian must agree to our Terms on your behalf.

Charges And Taxes. You are responsible for all carrier data plans, Internet charges, and other charges and taxes associated with your use of our Services.

5. Use

You are responsible for all activities that occur under your Account. You may not share your Account or login with anyone, and you agree to (1) notify Forghetti immediately of any unauthorised use of your Account or any other breach of security; and (2) exit from your Account at the end of each session.

6. Your information & your permissions

When you use our Services, you provide us with your name and profile preferences (“Your Information”). Your Information is yours. These Terms don’t give us any rights to Your Information except for the limited rights that enable us to offer the Services.

We need your permission to do things like hosting Your Information, backing it up, and sharing it when you ask us to.

7. Your responsibilities

You’re responsible for your conduct. Your Information and you must comply with our Acceptable Use Policy. Content in the Services may be protected by others’ intellectual property rights.

We may review your conduct and content for compliance with these Terms and our Acceptable Use Policy. With that said, we have no obligation to do so. We aren’t responsible for the information made available via the Services.

Help us keep you informed and Your Information protected. Safeguard your access to the Services, and keep your account information current. Don’t share your account credentials or give others access to your account.  We encourage you to use any device lock as provided on your devices to deter access to Forghetti and for that matter any other apps which may contain your Personal Information.

You may use our Services only as permitted by applicable law, including export control laws and regulations.

8. Software

Subject to your compliance with this Agreement, we grant you a limited non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and/or use the Services on any device that you own or control, solely for your own personal, non-commercial use.

You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply.   With respect to any App accessed through or downloaded from the Apple App Store (an “App Store Sourced Application”), you will only use the App Store Sourced Application (i) on an Apple-branded product that runs iOS (Apple’s proprietary operating system) and (ii) as permitted by the “Usage Rules” set forth in the Apple App Store Terms of Service.

Subject to the provisions below, Forghetti shall continue to provide you the Service for as long as you are entitled to receive them pursuant to the Third Party Terms. You are aware that unless you terminate the Services according to the Third Party Terms, such terms (and the payment obligations therefor) may provide that the Services, and payment therefor, may "roll-over" for additional terms.

Downloading Apps from iTunes.

The following applies to any App accessed through or downloaded from the Apple App Store (“App Store Sourced Application”):

(a) You acknowledge and agree that (i) this Agreement is concluded between you and Forghetti only, and not Apple, and (ii) Forghetti, not Apple, is solely responsible for the App Store Sourced Application and content thereof. Your use of the App Store Sourced Application must comply with the App Store Terms of Service.

(b) You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App Store Sourced Application.

(c) In the event of any failure of the App Store Sourced Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App Store Sourced Application to you and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App Store Sourced Application. As between Forghetti and Apple, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Forghetti.

(d) You and Forghetti acknowledge that, as between Forghetti and Apple, Apple is not responsible for addressing any claims you have or any claims of any third party relating to the App Store Sourced Application or your possession and use of the App Store Sourced Application, including, but not limited to: (i) product liability claims; (ii) any claim that the App Store Sourced Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

(e) You and Forghetti acknowledge that, in the event of any third-party claim that the App Store Sourced Application or your possession and use of that App Store Sourced Application infringes that third party’s intellectual property rights, as between Forghetti and Apple, Forghetti, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required by this Agreement.

(f) You and Forghetti acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement as related to your license of the App Store Sourced Application, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement as related to your license of the App Store Sourced Application against you as a third-party beneficiary hereof.

(g) Without limiting any other terms of this Agreement, you must comply with all applicable third-party terms of agreement when using the App Store Sourced Application.

In-App Purchases

Premium services may be provided upon the payment of a recurring fee. Amounts payable and the terms and conditions with respect to such payments shall be as set forth in the additional third party (a "Third Party") terms and conditions that govern the application marketplace from which you downloaded the relevant App, such as Apple’s AppStore or Google Play for Android (the "Application Marketplace" and the "Third Party Terms", respectively).

We may incorporate advertisements in an App or any feature of a Service. We do not control such advertisements and cannot guarantee that they are reliable or accurate. Inclusion of advertisements does not mean that we recommend or endorse the goods or services that they offer, and we bear no responsibility for any decision by you to purchase such goods or services.

Payment will be charged to your Store account at the point of confirmation of purchase.  Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.  Accounts will be charged for renewal within 24-hours prior to the end of the current period.  Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s account settings after purchase.

9. Our information

The Services are protected by copyright. These Terms don’t grant you any right, title, or interest in the Services, others’ content in the Services, Forghetti trademarks, logos and other brand features. We welcome feedback, but note that we may use comments or suggestions without any obligation to you.

10. Copyright

We respect the intellectual property of others and ask that you do too. We respond to notices of alleged copyright infringement if they comply with the law, and such notices should be reported via our contact page. We reserve the right to delete or disable content alleged to be infringing and terminate accounts of repeat infringers.

11. Competitions

forghetti may from time to time run competitions to promote the application and to support other businesses, charities and individuals.  forghetti reserves the right to end those promotions at any time.  Updates to these promotions will be posted via the relevant blog feed on the forghetti website.

12. Limitation of liability

(THE CUSTOMER’S ATTENTION IS PARTICULARLY DRAWN TO THIS TERM)

This clause sets out the entire financial liability of Forghetti (including any liability for the acts or omissions of its employees, agents, consultants, and subcontractors) to the Client in respect of (i) any breach of the Contract; (ii) any use made by the Client of the Services or any part of them; and (iii) any representation, statement or tortious act or omission (including negligence) arising under or in connection with the Contract.

Nothing in this Agreement limits or excludes the liability of Forghetti (i) for death or personal injury resulting from negligence; or (ii) for any damage or liability incurred by the Client as a result of fraud or fraudulent misrepresentation by Forghetti.

Forghetti will not be liable for (i) loss of profits; (ii) loss of business; (iii) depletion of goodwill and/or similar losses; (iv) loss of anticipated savings; (v) loss of goods; (vi) loss of contract; (vii) loss of use; (viii) loss of corruption of data or information; or (ix) any special, indirect, consequential loss,  or damage.

Forghetti’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance, or contemplated performance, of its obligations under this Agreement will be limited to the price paid for the Services giving rise to such liability and will not exceed the amount you have paid Forghetti in the past twelve months.

13. INDEMNIFICATION

If anyone brings a claim ("Third Party Claim") against us related to your actions, information, or content on Forghetti, you will, to the extent permitted by law, indemnify and hold the Forghetti harmless from and against all liabilities, damages, losses, and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of, or in any way in connection with any of the following: (a) your access to or use of our Services, including information provided in connection therewith; (b) your breach of our Terms or of applicable law; or (c) any misrepresentation made by you. You will cooperate as fully as required by us in the defence or settlement of any Third Party Claim. Your rights with respect to Forghetti are not modified by the foregoing indemnification if the laws of your country of residence, applicable as a result of your use of our Services, do not permit it.

14. Confidentiality

a) The Client shall not reproduce, duplicate, copy, sell, or otherwise disclose or disseminate the results of the Services, except as authorised herein.

b) either party shall publish, disseminate or disclose to any other person, firm, organisation or corporation, and shall protect against disclosure, the other party’s Confidential Information (as hereinafter defined).  

c) Each party agrees to use the other party’s Confidential Information only in connection with its obligations to be performed under this Agreement and shall disclose such information to its employees only on a need to know basis.  Confidential Information shall mean a party’s business and marketing strategies, including but not limited to employee and the Client lists, project plans, design documents, product strategies and pricing data, research, advertising plans, leads and sources of supply, development activities, the Client profiles, and other information of such party which by its nature can be reasonably expected to be proprietary and confidential, whether it is presented in oral, printed, written, graphic or photographic or other tangible form (including information received, stored or transmitted electronically).

d) Confidential Information shall not include any information that is: (i) already in the possession of the receiving party or its subsidiaries; (ii) independently developed by the receiving party or its subsidiaries; (iii) publicly disclosed by the disclosing party; (iv) rightfully received by the receiving party or its subsidiaries from a third party; (v) approved for release by written agreement with the disclosing party; (vi) available by the inspection of products marketed or offered for sale by either party hereto or others in the ordinary course of business; (vii) disclosed pursuant to the requirement or request of a governmental agency or third party to the extent such disclosure is required by operation of law, regulation or court order.

e) he provisions of this section shall survive the termination of this Agreement for a period of five (5) years.

15. Termination

We are always trying to improve our Service.  In line with this, we may add or remove our Services, features, functionality and the support of certain devices or platforms.  Our Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures.  We may discontinue some or all of our Services at any time after a notice period of 30 days, where possible.  Events beyond out control may affect our Services, such as events in nature and other events of force majeure.

16. Discontinuation of services

Whilst we hope that you remain a Forghetti user, you may terminate your relationship with Forghetti anytime for any reason by deleting your account.

We may decide to discontinue the Services in response to unforeseen circumstances beyond Forghetti’s control or to comply with a legal requirement. If we do so, we’ll give you reasonable prior notice so that you can export Your Information from our systems. If we discontinue Services in this way before the end of any fixed or minimum term you have paid us for, we’ll refund the portion of the fees you have pre-paid but haven't received Services for.  If you believe your account’s termination or suspension was in error, please contact us as support@forghetti.com.

17. General

(a) This Agreement shall be governed by and construed in accordance with English law without regard to conflict of law principles.  Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred.

(b) If any provision of this Agreement shall be held invalid in a court of law, the remaining provisions shall be construed as if the invalid provision were not included in this Agreement.

(c) If the performance of this Agreement, or any obligation hereunder, except the making of payments, is prevented, restricted, or interfered with by reason of any act or condition beyond the reasonable control of the affected party, the party so affected will be excused from performance to the extent of such prevention, restriction, or interference.

(d) If the performance of this Agreement, or any obligation hereunder, is not executed and/or not executed in full any payments made and/or payments to be made, shall be refunded and/or reduced pro rata.

(e) Neither party accepts any liabilities whatsoever under this Agreement in respect of the other party’s legal position.

18. Services "as is"

We strive to provide great Services, but there are certain things that we can't guarantee. TO THE FULLEST EXTENT PERMITTED BY LAW, FORGHETTI AND ITS AFFILIATES, SUPPLIERS AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED "AS IS." WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions don’t allow the disclaimers in this paragraph, so they may not apply to you.

19. Entire agreement

These Terms constitute the entire agreement between you and Forghetti with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third party beneficiary rights.

20. Modifications

We may revise these Terms from time to time to better reflect:

(a) changes to the law,

(b) new regulatory requirements, or

(c) improvements or enhancements made to our Services.

If an update affects your use of the Services or your legal rights as a user of our Services, we’ll notify you prior to the update's effective date by sending an email to the email address associated with your account or via an in-product notification. These updated terms will be effective no less than 30 days from when we notify you.

If you don’t agree to the updates we make, please cancel your account before they become effective. By continuing to use or access the Services after the updates come into effect, you agree to be bound by the revised Terms.

Acceptable Use

This acceptable use policy sets out the terms between you and us under which you may access our Forghetti (“forghetti”) website, www.forghetti.com (our sites) or mobile applications (“App”). This acceptable use policy applies to all users of, and visitors to, our sites. You should read this policy carefully and if you don’t wish to be bound by these, please do not use our websites or download our Apps.

Your use of our sites means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our Terms of Service (the “Terms”) and our Privacy Policy.  Note that Terms are available to read from within the application.

We make reasonable efforts to update the content on our websites and App, however either or both may be out of date at any given time. We are under no obligation to update our content and we make no representations, warranties or guarantees that the content on our websites or App is accurate, complete or up-to-date. Any opinion expressed is based on our judgement at the time of writing and is subject to change without notice.

Content and Advice

Our websites contain content that is for general information only and is not intended to be advice to you.

Accessing your account online or via the App

If you are a forghetti subscriber, you can access your forghetti account online or via the App and see details of your profile maintained on the forghetti systems.  You agree only to access or attempt to access the Service whilst you remain a client of forghetti.  If you or any authorised user representing you becomes aware that your account has been compromised or is known by any other person, you must notify us immediately. Your access to the Service will be suspended until we have reset your account.

Viruses, errors or omissions

We try to ensure that our websites and App are as good as we can make them, but we don’t guarantee that our websites, our App or any content on either will be free from errors or omissions.

Additionally, we don’t guarantee that our websites or App will be secure or free from bugs or viruses. We recommend that you use your own virus protection software.

Accessing our websites and downloading our App

Accessing our websites and downloading our App are subject to the terms and conditions of the service. We cannot guarantee that they will always be available or be uninterrupted. We may suspend, restrict, withdraw or change any part of our websites or App without notice.

Intellectual property rights

We own (or are licensed to use) all of the intellectual property rights in our websites and App, and in the content published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Limitation of our liability

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our websites or App or any content on either, whether express or implied.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

(a) your use of, or inability to use, our websites or App;

(b) your use of, or reliance on, any content displayed on our websites or App;

(c) your use of any links to other websites contained in our websites or App; or

(d) any virus, distributed denial-of-service attack or other technologically harmful material due to your use (in any way) of our websites or App.

We only provide our websites and App to subscribers. You agree not to use our websites or App for any personal use, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Misuse our websites

You must not misuse our websites or App by knowingly introducing viruses, trojans, worms, logic bombs or other materials which are malicious or technologically harmful. You must not attempt to gain unauthorised access to our websites or App, the server on which our websites or App is stored or any server, computer or database connected to our websites or App.

You must not attack our websites or App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them.

In the event of such a breach, your right to use our websites and App will cease immediately.

Prohibited uses

You may use our sites only for lawful purposes.

YOU MAY NOT USE OUR SITES

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (See Content Standards below).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

YOU ALSO AGREE:

  • Not to reproduce, duplicate, copy or re-sell any part of our sites in contravention of the provisions of our Terms & Conditions or Privacy Policy.
  • Not to access without authority, interfere with, damage or disrupt:
  • any part of our sites;
  • any equipment or network on which our sites are stored;
  • any software used in the provision of our sites; or
  • any equipment or network or software owned or used by any third party.

Use of and linking to our websites

You may only use our websites and App for lawful purposes. You may link to the homepage of our websites, provided you do so in a way that is fair and legal, does not damage our reputation or take advantage of it and that does not suggest any form of association or endorsement on our part where none exists. We may withdraw this linking permission without notice.

Content standards

These content standards apply to any and all material which you contribute to our sites (contributions), and to any interactive services associated with it.

You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.

CONTRIBUTIONS MUST:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable law in the UK and in any country from which they are posted.

CONTRIBUTIONS MUST NOT:

  • Contain any material which is defamatory of any person.
  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trademark of any other person.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our sites.  When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this Acceptable Use Policy may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our sites.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our sites.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy.  The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Your privacy is very important to us. Please read below to see how Forghetti handles information.

For the purpose of this Privacy Policy and the Data Protection Act 1998, Forghetti Ltd trading as Forghetti registered at 25 City Business Centre, Hyde Street, Winchester, Hampshire SO23 7TA, Registration no.: 10827780 is the ‘data controller’.

1. Information We Collect

Our primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalised experience while using our services. This allows us to provide services and features that most likely meet your needs, and to customise our service to make your experience easier and quicker.

This Privacy Policy should be read together with our Acceptable Use Policy and, if you are an Forghetti subscriber, our Terms & Conditions.

Information you give us

When you contract with us we may ask you for information that shall include but shall not be limited to: your name; contact information including email address, mobile phone number, address.  Note that Forghetti will never write to you via email for any purpose other than described at the time when you subscribe to receive information.  When subscribing to the Forghetti service we do not require your email subscription and all service authentication is performed using your mobile telephone number.  We will only send you SMS messages to complete the authentication of your account unless otherwise permitted by you individually.

Information we collect

With regard to each of your visits to our sites and applications, we use a web analytics tool to analyse site usage, how our users arrive at our site, what they do on the site, what browser they are using and on what operating system etc. However, this analytics data, collected via a JavaScript tag in the pages of our site, is not tied to personally identifiable information.  We use Google Analytics (http://www.google.com/analytics/) for this purpose.

COOKIES.

We use a number of different cookies on our site. If you do not know what cookies are, or how to control or delete them, then we recommend you visit http://www.aboutcookies.org for detailed guidance.

The following describes the cookies we use on this site and what we use them for. Currently we operate an ‘implied consent’ policy which means that we assume you are happy with this usage. If you are not happy, then you should either not use this site, or you should delete Forghetti cookies having visited the site, or you should browse the site using your browser’s anonymous usage setting (called “Incognito” in Chrome, “InPrivate” for Internet Explorer, "Private Browsing" in Firefox and Safari etc.).  If you block cookies, for the most part the websites should continue to operate normally, however there may be some areas where you may not be able to take full advantage of the website’s functionality.

PERSISTENT COOKIES FOR SITE ANALYTICS AND PERFORMANCE

SOCIAL BUTTONS

On our websites you may see 'social buttons'. These enable users to share or bookmark the web pages. There are buttons for: Twitter, Facebook, Instagram, LinkedIn, and other networks as added from time to time. In order to implement these buttons, and connect them to the relevant social networks and external sites, there are scripts from domains outside of Forghetti. You should be aware that these sites are likely to be collecting information about what you are doing all around the internet, including on Forghetti’s site. So if you click on any of these buttons, these sites will be registering that action and may use that information. In some cases these sites will be registering the fact that you are visiting www.forghetti.com and the specific pages you are on, even if you don’t click on the button if you are logged into their services, like Google and Facebook. You should check the respective policies of each of these sites to see how exactly they use your information and to find out how to opt out, or delete, such information.

EXTERNAL WEB SERVICES

We use a number of external web services on the Forghetti websites, mostly to display content within our web pages. For example to show videos we use YouTube. This is not the only service we use, or might use in the future, when embedding content, but it is the most common. As with the social buttons we cannot prevent these sites, or external domains, from collecting information on your usage of this embedded content. If you are not logged in to these external services then they will not know who you are but are likely to gather anonymous usage information e.g. number of views, plays, loads etc.

CHROME EXTENSION

The Chrome extension will capture and transmit the website that you are viewing in the active tab in order to determine which login within forghetti to generate when requested.

EMAIL TRACKING

Most standard emails that we send you have no tracking in at all.  Some marketing and all platform emails we track, at an individual level, whether the user has opened and clicked on the email. We rarely use the latter information at a personal level, rather we use it to understand open and click rates on our emails to try and improve them. If you want to be sure that none of your email activity is tracked then you should opt out of Forghetti's marketing emails which you can do at the bottom of every email you receive.

SURVEYS AND CONTESTS

From time to time our site may request information from users via surveys, contests or for a particular service (e.g. newsletter). Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested will include contact information (as supplied to the site during registration) and supplementary information on your interests, opinions and preferences (e.g. feedback on the Forghetti service). We will use the contact information to notify winners. We will not publish winners' details on the site though on request we will provide details of any winner's name. If the survey or contest has a sponsor then we may share information given by entrants with the sponsor, but only with the user's consent.

PAYMENT PROCESSING

In order to process payments Forghetti has partnered with Apple and Google and all subscription payments are made via the relevant app stores. For details of how this information is used, please see the app store terms and conditions.  We do not request for or hold any credit card information.

BLOG COMMENTS

In order to leave a comment in our Blog you have to give us at least your Name and Email address. You can choose whether to post as yourself, or anonymously. We require name and email address even for anonymous posts for quality control purposes.

2. Our Use of Your Information

We use personally identifiable information about you to improve our marketing and promotional efforts, to statistically analyse site usage, to improve our content and product offerings and to customise our site's content, layout, and services. We believe these uses allow us to improve our site and better tailor it to meet our users' needs.

We use your email address to send you newsletters or other communications that you have requested from our website. Out of respect for our clients we offer an opt-out (see Section 3 below).

We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve any disputes, troubleshoot problems and enforce our Terms & Conditions. At times, we may look across multiple users to identify problems or resolve disputes.

Your Personal Information is stored in our databases. Please note that the information you enter may be transferred outside the European Economic Area to the United States of America where it will be stored for the purposes of processing by Forghetti Ltd or any of its affiliates including subcontractors. By submitting your information, you consent to this transfer.

Forghetti complies with the UK Data Protection Act 1998 and from the 25th May 2018 the General Data Protection Regulation.

3. Email Communications

As part of the registration process you have the opportunity to opt in or out of various email communications. If at any stage you wish no longer to receive any emails that you receive you can unsubscribe or change your preferences on any of the emails that you receive.

4. Our Disclosure of Your Information

We do not sell or rent any personally identifiable information about you to any third party.

Unfortunately, due to the existing regulatory environment, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy.

By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. We can (and you authorise us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, Intellectual Property Rights infringements, or other activity that is illegal or may expose us to legal liability.

BLOG COMMENTS AND FORUM POSTS

If you post a comment to our Blog or post to our Forums then, by default, your name (first name, last name) will be published against your post, based on the information you submit.

BILLING INFORMATION

During the process of transacting through Forghetti, we collect and store information that we require in order to fulfill the service.  This will include your name, address, email address, phone number as well as similar information about other people in your business.  If you should require more information, please contact the data processor at Forghetti via our contact form.

MANAGING AND DELETING YOUR INFORMATION

We store information until it is no longer necessary to provide our services, or until your account is deleted, whichever comes first. This is a case-by-case determination that depends on things like the nature of the information, why it is collected and processed, and relevant legal or operational retention needs.

LEGAL REQUESTS

Forghetti cooperates with law enforcement inquiries and other third parties to enforce laws, Intellectual Property Rights and other rights. Local and international law enforcement agencies can request and may receive your personally identifiable information.

SUPPLIERS AND OTHER SERVICE PROVIDERS

From time to time we use third party Suppliers and Service Providers to facilitate our services. Where any Service Provider collects information directly from you (such as the situation where we ask a Service Provider to conduct a survey for us) you will be notified of the involvement of the Supplier or Service Provider, and all information disclosures you make will be strictly optional.

5. Security

We are committed to ensuring that your information is secure. In order to try to prevent unauthorised access or disclosure, we have put in place strict procedures and security features around the Apps and websites that we develop. Where possible, all services have active SSL Certificates in place.  However, transmission of information via the internet is not completely secure.  We do our best to protect your personal data, but we cannot guarantee the security of your data transmitted to our sites. Any transmission is at your own risk.

Where you have set a password to access an App and certain areas of the websites, please make sure you keep this secure.

The data that we collect from you will be typically transferred to, and stored at, a destination inside the European Economic Area (“EEA”). It will also be processed by staff operating inside the EEA who work for us or for one of our suppliers. This includes staff engaged in, among other things, the fulfilment of your order and the provision of support services.

We do use the services of several companies who are not located in the EEA.  We are only using the services of providers who are recognised as market leaders in their field.  This includes but is not limited to the following organisations.  All of these organisations have subscribed to the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (collectively, “Privacy Shield”). Where we need to transfer and store your data outside the EEA, we will do so only where we have assessed that equivalent data protection measures are in place. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

Forghetti does not ask you to create, store or remember a password.  That would be against all our principals.  Where you have chosen a pattern “doodle” to use within the application, you are responsible for keeping this confidential.  Even furnished with this information, people cannot get into your Forghetti account without your phone number and without your SMS authentication, but this does not negate the importance of keeping this confidential.

6. Changes to Privacy Policy

If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will make any changes to this Privacy Policy and post them to our site. It is up to you whether you then continue to use the site and Forghetti Ltd's services following such changes. However, it is assumed that you accept such changes if you continue to browse the Forghetti websites. If you do not accept such changes then you should stop using Forghetti's websites and services and contact us should you wish to have any of your details removed.
